A China trademark protects rights in China for the goods and services covered by its registration. Amazon Brand Registry is a separate Amazon program with its own eligibility rules. A China filing should not be presented as a guarantee of enrollment or of a marketplace takedown.
Who should plan a China filing?
Consider it if a Chinese manufacturer will make, package or label products under your brand; you plan to sell in mainland China; you are building a Chinese-language name; or a supplier, distributor or former partner could encounter your brand before you do. Filing early can reduce the risk that a later China application runs into a conflicting earlier filing.
Territorial planning matters. A registration in one jurisdiction does not automatically grant trademark rights in another. If you sell only in the US or EU but source from China, plan protection for each country in which you need rights rather than assuming your home-market registration covers the factory location.
A five-part seller checklist
1. Identify the owner before asking a factory to produce
Choose the person or company that will own the trademark and align that choice with product, packaging, marketplace and licensing plans. Keep applicant names consistent across trademark and business records.
2. Protect the exact brand customers recognize
List the English word mark, logo and any Chinese-language brand separately. Decide which version appears on the goods, packaging, storefront, invoice and Chinese marketing. A translation or transliteration is not automatically covered just because the English mark is filed.
3. Map products to realistic classes
Start with current SKUs and planned launches. Identify the goods themselves, any branded accessories and services offered under the same name. Do not assume that online retail alone replaces protection for the products. Use our China class selection guide as a starting map, then check the actual wording and classification.
4. Search before tooling, packaging or launch
Search for identical and similar marks in the likely classes before you print cartons, make molds, sign a long-term supply agreement or announce a Chinese brand name. A search informs the decision; it cannot guarantee the application will register.
5. Keep trademark ownership and marketplace records aligned
Amazon's eligibility and evidence requirements can vary by marketplace and change over time. Review the current Amazon Brand Registry guidance directly. Check the exact owner, mark representation and brand wording before applying; trademark registration and marketplace enrollment are separate decisions.
China registration and Amazon Brand Registry are different
Do not treat a China certificate as a universal marketplace credential. Amazon identifies the trademark offices and application status accepted for Brand Registry, and its rules determine enrollment. Conversely, marketplace enrollment does not itself replace a China trademark plan for production, Chinese sales or a local brand dispute.
Ask two separate questions: “Where do I need legal trademark rights?” and “Does my mark meet the current requirements of each marketplace program I want to use?” Verify the second question against the marketplace's live policy rather than relying on an old seller-forum answer.
Plan classes and cost before production
Our first-class application is $299 and includes the official filing fee and up to ten goods/services items. Additional classes are $299 each; items above the included ten are $10 each. This allows a seller to price a core product class plus carefully selected adjacent product lines before committing to a wider portfolio. See the full fee breakdown and six-step filing guide.
A practical next step
Prepare the mark as it appears on the product, the applicant's legal name, your current and planned products, and any China supplier or marketplace timeline. A written search can then focus on a meaningful scope rather than an incomplete brand-name check.
China's revised Trademark Law is scheduled to take effect on 1 January 2027. See the official law text published by CNIPA and confirm procedural requirements for the date of your filing.
Check your brand before the next production run
Send the brand name and a short list of your products. We will check the China register and provide a written risk report and fixed quote.
